 The Utah State Bar Website is comprised of various web pages operated by the Utah State Bar, including, without limitation, www.utahbar.org, www.mcleutah.org, admissions.utahbar.org, Utah State Bar Section websites, the Office of Professional Conduct website (opcutah.org) mobile websites, microsites, mobile applications, Utah State Bar profiles on social media sites and any other digital services or properties operated or used by the Utah State Bar from time to time (collectively referred to as the ” Utah State Bar Website”). By accessing or using the Utah State Bar Website you agree to comply with and be bound by these Terms of Use (“Terms of Use”). Please read these Terms of Use carefully as well as the Utah State Bar Privacy Policy.

Agreement between User and the Utah State Bar

The Utah State Bar Website is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Utah State Bar Website constitutes your agreement to all such terms, conditions, and notices.

Changes to Terms of Use

The Utah State Bar expressly reserves the right to change the terms, conditions, and notices under which the Utah State Bar Website is offered, including but not limited to the charges associated with the use of the Utah State Bar Website and the Terms of Use, without notice to you. You acknowledge and agree that it is your responsibility to review this site and these Terms of Use from time to time and to familiarize yourself with any modifications. Your continued use of the Utah State Bar Website after such modifications will constitute acknowledgement of the modified Terms of Use and agreement to abide and be bound by the modified Terms of Use.

Your Account

You will need your own account to use certain services on the Utah State Bar Website, and you must be logged in to that account in order to access those services. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. The Utah State Bar reserves the right to refuse service, terminate an account, terminate your use of the Utah State Bar Website or to remove or edit content in its sole discretion.

The Linked Sites are not under the control of the Utah State Bar and the Utah State Bar is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. The Utah State Bar is not responsible for webcasting or any other form of transmission received from any Linked Site. The Utah State Bar is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by the Utah State Bar of the site or any association with its operators.

Participation in Promotions

From time to time, this site may include advertisements offered by third parties. The Utah State Bar Website includes information that is intended to help consumers find legal assistance, learn about the law and the legal system in Utah, submit attorney complaints, and work better with attorneys. This site and the information provided, however, do not constitute legal advice and must not be used as a substitute for the counsel and services that you may require from an attorney authorized to practice law in your jurisdiction. Your reliance and use of the information contained in or linked from this site is done at your own risk. 

No Unlawful or Prohibited Use

As a condition of your use of the Utah State Bar Website, you warrant to the Utah State Bar that you will not use the Utah State Bar Website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Utah State Bar Website in any manner which could damage, disable, overburden, or impair the Utah State Bar Website or interfere with any other party’s use and enjoyment of the Utah State Bar Website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Utah State Bar Websites.

Conduct on the Utah State Bar Website

Your use of the site is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications through the site. By posting information in or otherwise using any communications service, chat room, message board, newsgroup, software library, or other interactive service that may be available to you on or through this site (collectively, “Communication Services”), you agree only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
  • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents.
  • Infringe on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party
  • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.
  • Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Services specifically allows such messages.
  • Conduct or forward surveys or contests unless such Communication Services specifically allows such messages.
  • Forward pyramid schemes or chain letters.
  • Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restrict or inhibit any other user from using and enjoying the Communication Services.
  • Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
  • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
  • Violate any applicable laws or regulations.
  The Utah State Bar has no obligation to monitor the Communication Services. However, the Utah State Bar reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. The Utah State Bar reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever. The Utah State Bar reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the Utah State Bar’s sole discretion. Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. The Utah State Bar does not control or endorse the content, messages or information found in any Communication Service and, therefore, the Utah State Bar specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized Utah State Bar spokespersons, and their views do not necessarily reflect those of the Utah State Bar. Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

Electronic Communications

When you use the Utah State Bar Website, or send emails, text messages, and other communications from your desktop or mobile device to us, you consent to receive electronic communications from us, such as e-mails, texts, mobile push notices, or notices and messages on this site or otherwise. You should retain copies of those communications for your records. You agree that all agreements, notices, disclosures and other communications that we may provide to you electronically satisfy any legal requirement that such communications be in writing.

License to Use Materials Submitted to the Utah State Bar

The Utah State Bar does not claim ownership of the materials you provide to the Utah State Bar (including feedback and suggestions) or post, upload, input or submit to any Utah State Bar Website or its associated services (collectively “Submissions”). However, by posting, uploading, inputting, providing or submitting Submission you are granting the Utah State Bar, its affiliates and necessary sub-licensees permission to use your Submission in connection with the operation of Utah State Bar business including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submissions; and to publish your name in connection with your Submissions.

No compensation will be paid with respect to the use of your Submissions, as provided herein. The Utah State Bar is under no obligation to post or use any Submission you may provide and may remove any Submissions at any time in the Utah State Bar ‘s sole discretion.

By posting, uploading, inputting, providing or submitting your Submissions you warrant and represent that you own or otherwise control all of the rights to your Submissions as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

E-Business Transactions

When you purchase products or services through the Utah State Bar Website, you may utilize a third-party e-business vendor. By utilizing a third-party e-business vendor’s service to purchase products or services from the Utah State Bar Website, you agree to the third-party vendor’s terms of use.

CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. THE UTAH STATE BAR MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE UTAH STATE BAR WEBSITE AT ANY TIME. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE UTAH STATE BAR WEBSITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE UTAH STATE BAR WEBSITE.

Indemnification

You agree to defend, indemnify, and hold the Utah State Bar and its Affiliates harmless from all liabilities, claims, and expenses, including attorney fees, that arise from your use or misuse of this site. The Utah State Bar reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with the Utah State Bar in asserting any available defenses.

Termination of Access to Utah State Bar Website

The Utah State Bar reserves the right, in its sole discretion, to terminate your access to the Utah State Bar Website and the related services or any portion thereof at any time, without notice.

General Terms

To the maximum extent permitted by law, this agreement is governed by the laws of the State of Utah, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in Salt Lake County, Utah, U.S.A. in all disputes arising out of or relating to the use of the Utah State Bar Website. Use of the Utah State Bar Website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and the Utah State Bar as a result of this agreement or use of the Utah State Bar Website.

The Utah State Bar ‘s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of the Utah State Bar ‘s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Utah State Bar Website or information provided to or gathered by the Utah State Bar with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between you and the Utah State Bar with respect to the Utah State Bar Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and the Utah State Bar with respect to the Utah State Bar Website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.
