Fall Forum

Please make plans to join us at the Fall Forum the evening of Thursday, November 8th, and all day Friday, the 9th, at the Little America Hotel. On Thursday evening, Ellyn S. Rosen, Counsel to the ABA Standing Committee on Professional Discipline will speak on Ethics 20/20 and the likely changes to the model rules. Professor Jeffrey J. Rachlinski will be our keynote speaker on Friday speaking on implicit bias. Professor Rachlinski holds a B.A. and an M.A. in psychology from the Johns Hopkins University, and a J.D. and a Ph.D. in Psychology from Stanford. The Fall Forum offers 8 hours CLE, including up to 2 hours of Professionalism and Civility credit and up to 5 hours of Ethics credit. Nominations for Bar President-elect – The Board of Bar Commissioners is requesting nominations to the office of Bar President-elect. Applicants for the office of President-elect must submit their notice of candidacy to the Board of Bar Commissioners by January 2, 2013. Applicants are given time at the January Board meeting (January 25, 2013) to present their views. Secret balloting for nomination by the Board to run for the office of President-elect will then commence. Any candidate receiving the Commissioners’ majority votes shall be nominated to run for the office of President-elect. Balloting shall continue until two nominees are selected. Bar Commission Openings – Nominations to the office of Bar Commissioner are hereby solicited for two members from the Third Division, one member from the Second Division, each to serve a three-year term. Terms will begin in July 2013. To be eligible for the office of Commissioner from a division, the nominee’s business mailing address must be in that division as shown by the records of the Bar. Applicants must be nominated by a written petition of ten or more members of the Bar in good standing whose business mailing addresses are in the division from which the election is to be held. Nominating petitions are available athttp://www.utahbar.org/elections/commission_elections.html. Completed petitions must be submitted to John Baldwin, Executive Director, no later than February 1, 2013 by 5:00 p.m.

In MemoriamJudge Glen Edward Clark died on October 25, 2012 at his home on Saint Simons Island, Georgia with heart, liver and cancer complications. Judge Clark earned his J.D. Degree from the University of Utah in 1971 where he was Articles Editor of the Utah Law Review and was awarded membership in the Order of the Coif. He practiced law with Fabian & Clendenin from 1971 until 1982. He served on the American Bar Association UCC Committee and its Subcommittee on Commercial Paper, Bank Deposits and Collections and Letters of Credit. In 1982 he was appointed as a United States Bankruptcy Judge. He was a Visiting Associate Professor of Law and an Instructor of Advanced Business Law at the University of Utah, Graduate School of Business. In 1986 he became Chief Judge of the United States Bankruptcy Court for the District of Utah. Judge Clark retired from the bench in January 2009 to the beautiful and serene Saint Simons Island.

Utah State Bar Energy, Natural Resources & Environmental Law Section Award Recipients Named and Officers ElectedDenise Chancellor, recently retired from the Utah Attorney General’s Office, has been presented with the 2012 Edward W. Clyde Distinguished Service Award by the Energy, Natural Resources & Environmental Law Section of the Utah State Bar. Ms. Chancellor was recognized for her knowledge and experience, her tireless work on behalf of the citizens of Utah in significant environmental law cases, and her personal integrity. Amanda Smith, Executive Director of the Utah Department of Environmental Quality, has been named the 2012 Lawyer of the Year by the Energy, Natural Resources & Environmental Law Section of the Utah State Bar. Ms. Smith was recognized for her leadership in pursuing and implementing recent legislation that created new adjudicative procedures for administrative appeals of environmental permits and licenses before the Utah Department of Environmental Quality (“DEQ”), restructured the DEQ Boards, and clarified the duties of the DEQ Boards and the DEQ Division Directors. Both awards were presented at a luncheon on October 23, 2012, at the Utah Law & Justice Center. The Utah State Bar Energy, Natural Resources & Environmental Law Section Officers for 2012-2013 will be: Chair – Brian W. Burnett of Callister Nebeker & McCullough; Vice-Chair – Shawn T. Welch of Holland & Hart; Secretary – Michael S. Johnson of the Utah Attorney General’s Office; and Treasurer – Elizabeth A. Schulte of Parsons Behle & Latimer.
