Litigation Section Executive Committee Minutes of October 11, 2000 Meeting
The Executive Committee of the Litigation Section met on Wednesday, October 11, 2000, at 8:00 a.m. at the Law and Justice Center in Salt Lake City.
Attendance. Present were Tracy Fowler, Bruce Badger, Frank Carney, Brent Manning, and Dino Himonas. Also present was Kent Scott.
Minutes from Last Meeting. The minutes from the September 13th meeting were reviewed and approved.
Resignation and new member. Frank Pignanelli will restrict his involvement to legislative reports during the session. He will not be attending our meetings. On Frank=s suggestion, Deno Himonas from
Jones, Waldo joined our Executive Committee and was welcome to our meeting.
CLE on depositions. This is set for October 26th. Willis Orton and Rod Snow are handling it. We need more notification and advertising of the program.
5. Mid-Year Meeting: Keynote Speaker.
Kent Scott reported that the Litigation Section should plan on sponsoring the keynote speaker and also fill two breakout slots. We discussed the keynote speaker: Brent Manning is trying to find the medical ethicist from Oklahoma; Kent Scott is considering a lawyer from Kentucky talking about a products liability case against the makers of the computer game Doom. The Rev. France Davis was also suggested. We are in general agreement that the keynote speaker should not be a nuts-n-bolts litigation speaker but, rather, a speaker of more general interest. The soft commitment date is November 1st to line up a keynote speaker.
6. Mid-Year Meeting: Breakout Sessions.
We also discussed potential breakout session topics: minority de-representation at the top (Brent Manning); computer assisted evidence (Bruce Badger); problems with special verdict forms (Frank Carney).
7. Web Page.
Frank Carney noted that the Judges= Bench Book is progressing slowly. Anyone who can volunteer to interview a judge would be appreciated. We=ll try to make the site more noticeable within the bar=s web page.
8. Larry Pozner Seminar. A seminar on cross examination with Larry Pozner is set for April 19th from 2:00 to 7:00 p.m. at the Law & Justice Center.
9. ADR Seminar on January 16th.
Kent Scott discussed a suggestion by Karin Hobbs for a seminar on mediation on appeal and would co-sponsored with the ADR Section. The point would be to introduce people to the mediation system in the Tenth Circuit and the Utah appellate courts. Tracy Fowler suggested this might be combined with a presentation on being more effective in mediation. The idea would be a short, one or two-hour seminar. We agreed to do this. Tracy will handle the arrangements.
10. Trial Academy. Frank Carney reported that the next session is on November 26th, again at Westminster College, on the subject of Closing Arguments.
11. MUJI. The MUJI- Civil Second Edition is needed. Tracy Fowler will followup with John Young on this.
12. List Serve. We need to ensure that all with email addresses are included.
13. Annual Meeting in Sun Valley. Brent Manning will act as our liaison.
14. Next Meeting. The next meeting of the Executive Committee was set for Wednesday, November 8, at 8:00 a.m., at the Law and Justice Center.
There being no other business to discuss, the meeting adjourned at 9:00 a.m.
