Litigation is the legal term used to describe the process involved in obtaining an order from a court through a disputed process.  Sometimes it is necessary for the parties to file an action and ask that the court make a determination about how to settle the issues.  Domestic cases are not tried by a jury. The judge or commissioner will make the decision.

Sometimes it is necessary to go to court in order to obtain an order, even if the parties agree about the result. When the parties are in agreement, they can submit a written stipulation and order. When the judge signs the order it will have the same effect as if the parties were in court.  However, a stipulation itself is not an order. Until an order is signed by the judge, it does not have the effect of an order
