Minutes of October 10, 2001 Meeting

Litigation Section Executive Committee

The Executive Committee of the Litigation Section met on Wednesday, October 10, 2001, at 8:00 a.m., at the Law and Justice Center in Salt Lake City.

1. Attendance. Executive Members present were Frank Carney, Mike Petrogeorge, Christy Romero, Deno Himonas, and Rod Snow.

2. Interest on Litigation Section Account. Frank Carney reported that the Bar Commission has agreed to make a donation to “And Justice For All” in the amount of the interest on Section account balance. John Baldwin’s communication of the Commission’s decision is as follows:

The Commission voted last Thursday to have an amount contributed to "and Justice for all" which represents the section's interest over the last fiscal year. There was a broad discussion regarding the request specifically and the concept generally, particularly as it relatesto other sections. There were expressions of overall appreciation for thework of the section and the charitable intent of the gesture. ArnoldBirrell is calculating the amount. The Commission did consider this as acurrent request and not yet as one for perpetual allocation, so there maystill need to be discussion between the section and them on the concept.We'll get back to you with the amount and you can tell us how you want toproceed with the contribution of the funds right now.

3. Members’ Survey. Frank Carney reported on the results of the members’ survey. Those results are attached.

4. Annual Meeting Committee Representative. Christy Romero reported that she attended the last meeting of the Annual Meeting Committee. The Annual Meeting will take place in Sun Valley on June 26-29, 2002, a week earlier than usual. We are scheduled for four one-hour presentations by David Ball and one hour-long session on Saturday morning. Christy will work with the Young Lawyers’ Section to arrive at a topic for the Saturday session. Frank Carney will give her the topics upon which David Ball will speak. We will also be expected to contribute towards the expenses of the keynote speaker, but who that will be has not been determined. All speakers and programs should be designated by November 8th.

5. Status of Judge’s Benchbook Interviews. Frank Carney and Scott Reed met yesterday with the Fourth District judges and most of them have agreed to provide materials for the Benchbook. Deno Himonas continues to work on getting the St. George judges to submit their materials.

6. Status of Mentors’ Page. Frank Carney reported that there was no response to the advertisement in the Bar Journal. The Mentors’ Page is receiving no inquires at all. Mike Petrogeorge suggested that we attend the mandatory new lawyer CLE to plug the web page and Frank Carney will arrange for this.

7. MUJI- Civil (2d Ed.) Frank Carney reported that this project is essentially on hold pending the completion of MUJI- Criminal.

8. Evening with Third District Judges. Frank Carney reported that this seminar is ready to go; Judge Nehring and three other Third District judges will attend and speak on Motions Practice and other issues. An email to Section members publicizing the event and soliciting comments for the judges will go out this week.

9. Amendments to Experts Rules. Frank Carney reported that the Supreme Court has rejected the proposed changes to Rules 701-703, Utah Rules of Evidence, in their entirety.

10. Next meeting. Our next meeting was set for 8:00 am on Wednesday, November 14th.

There being no other business to discuss, the meeting adjourned at 8:40 a.m.
