Minutes of March 14, 2001 Meeting

Litigation Section Executive Committee

The Executive Committee of the Litigation Section met on Wednesday, March 14, 2001, at 8:00 a.m. at the Law and Justice Center in Salt Lake City.

Attendance. Present were Frank Carney, Tracy Fowler, and Brent Manning.

Approval of minutes. The minutes from the last meeting were reviewed and approved.

Web Page. Frank Carney reported that the web page is slowly progressing. About two-thirds of the Third District judges are on-line with us in the "Judges' Bench Book.." We have Leslie Larson in Cache County to interview the two remaining holdouts. We will then concentrate on the Second District judges. A plug should be made at the Annual Meeting in Sun Valley to the judges on this and Frank Carney will squeeze it in to the end of both Rod Snow's and Shawn McGarry's presentations.

Mid-Year Meeting. Tracey Fowler reported that this was all set to go beginning on March 15 in St. George.

Email to members. Frank Carney is still committed to putting together an email to all Litigation Section members on current projects and the upcoming seminars. Tracey Fowler will sign it as Section President.

Expanding listserve coverage. Our listserve will be updated with the registration renewals in June. However, that only gets bar members who list their email addresses with their registration materials. We again discussed paying a secretary to compare the email addresses that we have with those available from other sources. The decision was to hold off on this and revisit it in July, once we have the new registration information.

Annual Meeting: Rod Snow Breakout Session. Rod Snow reported on his breakout session, "What Judges/Lawyers Want" from each other. The judges and the lawyers are lined up and include Judges Benson, Nehring, Stott, and Kay. The lawyers will be Rod Snow, Brent Manning, Jan Smith, and Jerry Mooney. However, Rod wants to survey the Litigation Section on issues that might be discussed and he will get a draft survey to Frank Carney who will attend to getting it to the members by email.. He also wants to survey the judges and we will send this by ordinary mail. Frank Carney has been approved to buy a door prize of a Palm Pilot to award to one of the judges in attendance.

Annual Meeting: Shawn McGarry Breakout Session. Shawn McGarry reported that he is set for a presentation on Saturday morning on the subject of "Civility- the View from the Bench." We discussed the possibility of subject overlap with Rod Snow's presentation; Shawn will work this out with Rod.

Annual Meeting: Law & Economics Breakout Session. We are co-sponsoring a session on the Robinson-Patman Act. This is apparently all prepared although we have no real involvement with it.

Accountant as Exec Comm member (Fowler). Two accountants have asked to join our Section. We voted not to allow this as it appears to be nothing more than marketing.

Cliff Osmond Seminar: February 23/24. Frank Carney reported that the Cliff Osmond seminar had to be canceled for lack of interest. We paid a $500 cancellation fee to Mr. Osmond.

Larry Pozner Seminar: April 19th. Frank Carney reported on the status of this event. So far approximately forty people are signed up to attend and FJC will commence to beating the bushes to drum up attendance for this.

Next Meeting. The next meeting of the Executive Committee was scheduled for Wednesday, April 11th, at 8:00 a.m., as usual at the Bar Offices.

There being no other business to discuss, the meeting adjourned at 9:00 a.m.
