Executive Committee
The Executive Committee of the Litigation Section met on Wednesday, April
9, 2003, at 8:00 a.m., at the Utah Law & Justice Center in Salt Lake
City.

1. Minutes.
The draft minutes from our last meeting were reviewed and approved.
2. Annual Dues. Bruce Badger raised the issue of dues
for the coming year.
Wayne Klein suggested waiving the dues for the coming year. Frank Carney
was opposed to this, as were others. The dues will stay the same, $25/year,
waived for new members’ first year.
3. Hal Davis. He has inquired about our interest in
a technology seminar.
4. Voir Dire Questions. Tim Shea. Topic for Evening
for Judges
5. Mid-Year Meeting in St. George. Willis Orton reported
that presentations were only fair and there were not many litigation-related
matters. We had only one speaker
6. Annual Meeting in Sun Valley: July 17-19. Bruce Badger
reported that we have been scheduled to present three breakout sessions;
one on Thursday and two on Friday:
a. A judges’ panel on effective advocacy. Judge Skanchy, Judge
Kay McIff, and Judge Bruce Jenkins will be on this panel, but we need
a moderator.
b. The second session will be Doug Clark speaking on Sarbanes-Oxley
changes and related issues, as he did in October in St. George.
c. The third topic is a panel featuring Judge Mike Murphy on “Advocacy
before the Tenth Circuit.” Mike Petrogeorge will followup on questions.
Each member of the Executive Committee is asked to submit possible questions
that should be e-mailed to Lee Curtis.
The judges will be comped for all fees and allowed up to $1,000 for expenses.
7. MUJI Supreme Court Advisory Committee
Bruce Badger found the contract with Michie on MUJI. It allows Michie
publication rights for five or six editions. However, it is an agreement
with the Bar and for the Bar’s work. It is hoped that MUJI will
be available online, just as the court rules are. This would be in addition
to the published looseleaf of instructions.
8. Larry Pozner/Roger Dodd Seminar: May 2nd
Frank Carney reported that advertising is underway and we expect to draw
135- 150 attendees.
9. Annual Meeting Awards.
a. Lawyer of the Year. Deno Himonas suggested Mark Glick at Parsons.
He is Chair of the Law and Economics section. Published a book and many
articles. Other names that were discussed were David Jordan and Loni
Deland. We decided not to make a recommendation.
b. Judge of the Year. Ron Boyce was our unanimous choice.
10. David Ball Seminar: October 17.
Frank Carney reported that this is all set to go. Advertising will start
in late summer.
11. Evening With Third District Court: November 19.
Willis Orton is in charge of this. We agreed to ask Judges Peuler, Fratto,
Quinn, and Hilder to attend. Hilder, Peuler are on; we will ask Fratto
and Quinn. Voir dire might be the topic.
12. Robert Musante Depositions Seminar: December 15.
Robert Musante from Southern California does a day-long seminar just on
depositions and comes highly touted. We might bring him here instead of
doing our own “depositions” seminar in December. Frank Carney
agreed to speak with him and make a recommendation at our next meeting.
The meeting adjourned at 9:00 a.m. Our next meeting was set for Wednesday,
May 14, 2003, at 8:00 a.m. at the Law & Justice Center.
