Minutes - October 8, 2008

Present: Rick Hummel, Lauren Barros, Helen Christian, Stacey Schmidt, Commissioner Blomquist, Judge Douglas B. Thomas, Angela Fonnesbeck, Stewart Ralphs, John Sheaffer, Russ Minas, Doug Adair, Judge Jones (by phone), Charlotte Meacham (by phone) and Adam Caldwell (by phone).

Excused: Christina Miller, Dena Sarandos, Louise Knauer, Lisa Lokken, Marci Keck, John Moody, Kellie Williams and Al Pranno. Approval of Minutes: John welcomes everyone and invites comments on the minutes from September. A motion was made to approve the minutes. It was seconded and the motion passed with unanimous approval.

S Subcommittee Reports:

Legislation Committee. Stewart commented on the status of the proposed Rule 108. It was motioned and approved that Stewart move forward with submitted proposed Rule to the AOC and other appropriate people to be considered for implementation. Stewart also commented on the current draft of the Violation of Protective Order statute to be presented by Senator McCoy. Stewart reports that the Senator has spent considerable time with the DV community to draft a bill that addresses the actions of Petitioners while also not undermining those in need of domestic violence protection. It was determined that we would address this bill as we do other legislation during the regular legislative session.
Christmas Social. Helen reported that the Christmas party could be held on the 2nd, 4th or 11th of December. After discussion it was determined that the section Christmas social will be held on December 4th with additional details including location to follow. Scholarship Committee. John reported that the letters previously approved were sent to D ofD and BYU. There had been no word from the D, but BYU has started forming their committee and asked us to appoint a member to serve on that committee. After discussion by the Board it was moved, seconded, and approved that Commissioner Blomquist and AI Pranno serve, one each, on the scholarship committees ofthose schools.
Spring Convention. Rick reported that he was searching for topics for the Spring Convention. Several topics were discussed including the American Family Conciliatory Courts and a presentation by Jill Sanders, Juvenile Court and Polygamy issues, military law and retirement benefits with possible presentations by Craig Peterson and/or Neil Crist, QDROs, grandparental rights, and bifurcation issues.
Monthly Seminars. Doug reported that the dates had been reserved for upcoming monthly luncheons. On October 24 there will be a presentation by David Dodgion regarding psychosexual sexual evaluations. On January 25, 2009 Valerie Hale will do a presentation on hot tips in custody evaluations. The February 27, 2009 luncheon will likely deal with ORS issues and the April 24, 2009 luncheon will likely be a legislative update. Doug and Angela are also trying to arrange a joint family law luncheon with the Cache County bar in March.

Grant Request from "And Justice for All:" The committee discussed that in years past we have contributed $5000 and an additional $1000 for the Southern Utah Community Legal Center. As part of this conversation Adam renewed the request for the $1000. It was motioned, seconded and approved that $6000 be donated to "And Justice for All" with the designation that $1000 was to be forwarded to the Southern Utah Community Legal Center.
Grant Request from "Annual Dialog on Democracy:" The Annual Dialog on Democracy has requested a $500 donation for a table at their annual event promoting civility etc ... The pros and cons were discussed. Angela motioned that the $500 donation request be granted. Helen seconded and the motion passed with the amendment (made by Stewart, seconded by Russ) that we wanted the family law section table full and thus would offer the tickets to section members on a first come first serve basis in exchange for $50 per ticket or for volunteer participation in the free legal clinic in Salt Lake. Stewart agreed to send an e-mail to the section.
Financials:
John reported that our balance sheet shows approximately $15,000.00 but from that amount we need to fund the $6000 to "And Just for All," the $500 for the "Annual Dialog on Democracy," and the $3000 for the U ofU and BYU family law scholarships. It was also mentioned that we may still be responsible for a small amount on the joint luncheon held with the bankruptcy sections. It does not appear that there is any revenue for July or August and there is some concern as to whether we received the yearly renewal fees. John agreed he would follow up and report back. Other Business: There was some discussion about a section e-mail to make attorneys more aware ofthe Free Legal Clinic and the need for volunteers.
Adjournment.
There being no other business the meeting was adjourned until November 12, 2008.
