Minutes: November 6, 1997

Present: Mark Lehman, Earl Tanner, Kent Alderman, Gary Henrie, and Steve Dixon.

The Committee approved the minutes from September 4, 1997.

1. CLE. Kent presented a revised schedule of Estate Planning Section meetings.

2. Legislation. Mark reported that the Interim Committee had approved the Article Two change to the Utah Uniform Probate Code. Both Lyle Hillyard and John Valentine seem to support the proposed bill. The Bar's Legislative Affairs Committee has been presented with the bill and their approval is expected.

3. Unauthorized practice. This section needs a chairperson for unauthorized practice. Earl will inquire whether Paul Barton is interested. Mark suggested consumer fraud was a possible cause of action. Kent suggested that a survey could be taken through the Elder Law project of the number of Wills being produced by non-lawyers. Earl suggested direct public advertising of possible cause of action against non-lawyers providing Wills and Trusts.

4. Internet Site. Mike Osterloh with "At law" will assist in creating an Internet site for the Estate Planning Section. Suggestions were made that the site could include scheduled meetings, CLE written materials, etc.
