UTAH STATE BAR APPELLATE PRACTICE SECTION
EXECUTIVE COMMITTEE MEETING MINUTES
March 9, 2005
In attendance: Scott M. Ellsworth (Chair), Tawni Sherman
(Secretary/Treasurer), Lori J. Seppi (Council Member)
I. Past meetings. The Committee reviewed the minutes
of the October and December 2004 meetings.
II. CLEs: The Committee reviewed the progress of the
following proposed CLE programs:
• Half-day oral argument seminar presented by a luminary
in the field. Possible date: we are now looking at sometime from
July through September 2005. Ken Bronston reported to Scott Ellsworth
in early March that Michael Dreeben had declined the invitation. Ken
is contacting David C. Frederick and Beth S. Brinkmann as other possible
speakers. He pointed out that we would likely need to co-sponsor the
program with the Litigation Section, unless the chosen speaker does
not require an honorarium. Ken also opined that even if the speaker
requires an honorarium, the Appellate Practice and Litigation sections
would likely need to spend only about $500 each out-of-pocket once seminar
fees are accounted for. Scott Ellsworth will follow up with Ken on this
seminar.
• Justice Wilkins speaking on oral advocacy. Possible
date: February 2005. Scott Ellsworth will follow up with Ken on this
seminar.
• Panel of federal judges to discuss oral advocacy. Possible
date: February 2005. Tawni Sherman will follow up with Mike Lee on this
seminar.
• Panel of Utah judges to discuss oral advocacy. Possible
date: early Fall 2005. Scott Ellsworth will follow up with Ken Bronston
on this seminar.
• NLCLE on the basics of appellate practice, presented
by Kent and Chris once appellate primer is complete. Kent Hart reported
recently that there are about half-a-dozen administrative rules that
still need to be addressed, and that once that section is complete the
primer will be ready for final revisions. The Committee suggested that
we have each member of the Committee participate in the editing process.
• The Committee discussed a possible future CLE discussing “bad
briefs.” This would be, in essence, a seminar on appellate writing
taught by negative example. The Committee members who were present will
begin gathering examples of bad briefs for future use.
III. Financial Report: As of February 28, 2005, the
Section’s Total Liabilities and Fund Balance is $11,199.75.
IV. Next meeting: We agreed that the Committee should
meet some time in April to discuss the progress of the CLEs that are in
progress. Scott Ellsworth will circulate an email to schedule the next
meeting.
