UTAH BAR SEEKING ABA REPRESENTATIVE:

American Bar Association Representative

The Board of Bar Commissioners is seeking applicants to serve a two-year term as the Bar’s representative to the American Bar Association’s House of Delegates to replace Charlotte Miller who will then serve as the delegate of the Utah members of the ABA. The term would run through the August 2011 ABA Annual Meeting.

Please send your letter of application and resume no later than Monday, October 5, 2009 to John C. Baldwin, Executive Director, Utah State Bar, at jbaldwin@utahbar.org or 645 South, 200 East, Salt Lake City, Utah 84111.

The ABA House of Delegates meets two times a year during the ABA conventions. There will be some preparation work to review issues and communicate with the Bar Commission. UMBA BANQUET:

The Annual Scholarship and Awards Banquet is October 23, 2009, less than 3 months away. Letters requesting donations; scholarship and table sponsorships; and RSVP forms will be coming out within the next few weeks. The UMBA Board is seeking volunteers to assist with pre-banquet preparation that needs to be done now, as well as with the banquet and silent auction. Please consider helping us be able to continue this long-standing tradition. We could not undertake this event without your assistance. Whether you can spare time now or closer to the banquet, we can find tasks that work with your schedule.     Employment Counsel

    One of our businesses is a Salt Lake City headquartered, multi-concept restaurant operating company. It has experienced a phenomenal growth and now has 99 units in Utah, Colorado, Washington, Idaho, and Nevada, with further expansion into 3 more states in 2009.

    The lawyer will assist the Company with a wide variety of human resource-related legal challenges, including claims of discrimination and harassment, employment contracts, and government citations (NLRB, EEOC, DOL, etc.). The Lawyer will additionally provide comprehensive services related to HR legal due-diligences and post-transactional integration, hiring issues, employment litigation, training, auditing, and management issues.

    Key Success Factors

  • Improve employment labor law audit components; this will include immigration audits,
  • FLSA, and state law compliance.

  • Increase company’s adherence to state and federal labor laws.

  • Continue to build upon Company’s employment litigation success.

  • Ensure unemployment and workers compensation success.

  • Drive efficiencies in the Company’s handling of employee redundancies and dismissals.
  • Candidate Profile

    The successful candidate will possess the following:

  • A minimum of 3 years of employment law advisory and litigation experience within a specialized employment law practice. Ideally with some corporate or transactional experience in the employment arena.
  • Must be admitted to practice law in Utah (Bar License or In-House Counsel).
  • Very strong technical knowledge of employment law and related legal practice areas required of the role.
  • High level of connectivity and engagement with the HR organization and business management.
  • Ability to exercise sound legal judgment with minimal supervision regarding matters with potentially significant financial and legal implications.
  • Very strong professional and ethical standards.
  • Ability to handle a wide variety of tasks simultaneously in a fast-paced environment.
