Pending final approval by the Utah Supreme Court via petition, the Bar Commission recently approved several changes to the Bar's by-laws relating to lawyer commissioners, President and
President-elect vacancies and removal procedures.
A vacancy for all commissioners will be defined as: ”death, resignation, incapacity, retirement, removal, change of residence from the State of Utah (in the case of the President or
President-elect) or change of residence from the division from which elected (in the case of a lawyer commissioner), or upon the incumbent ceasing to be an active member of the Bar in
good standing.”
For both lawyer commissioners and officers (President and President-elect), removal from the Board of Commissioners may be accomplished by either: (1) a vote of the Commission (9 of 13
voting commissioners in the case of officers, or 8 out of 12 voting commissioners in the case of a lawyer commissioner); or (2) the vote of a majority of the active members of the Bar
voting in a special election held for the purpose of consideration of removal.
