Commission Highlights

During its regularly scheduled meeting December 1, 2000, which was held in Salt Lake City, the Board of Bar Commissioners received the following reports and took the actions indicated.

1.Nanci Bockelie presented the proposed Client Security Fund disbursements and the Commission voted to approve the claims. The Commission also approved a motion to file a petition with the Utah Supreme Court to increase the Client Security Fund corpus to $200,000, which would allow the Commission the authority to assess members up to the amount of $20.00 per year.

2.Tim Shea from the AOC, gave a report on Jury Reform.

3.Gary Sackett of the Ethics Advisory Committee, explained the additional modifications to Ethics Advisory Opinion 00-05. A minor change was requested that footnote 2 be modified. The Opinion was approved and it was noted that the Ethics Advisory Opinion Committee had done an outstanding job in carefully drafting the opinion.

4.A discussion was held on the proposed amendments to Ethics Advisory Committee Rules.

5.The names of Nanci Bockelie, Cal Gould and Randy Kester were given to Tim Shea for the open slot on the Judicial Council's Standing Committee.

6.The Commission had lunch with lawyer Legislators and was given a Legislative preview.

7.Discussion was held on the appointment of a Multi-Jurisdictional Practice Committee.

8.Herm Olsen was re-appointed to the DNA Board.

Notice of Election of Bar Commissioners
Second and Third Divisions

Pursuant to the Rules of Integration and Management of the Utah State Bar, nominations to the office of Bar Commission are hereby solicited for one member from the Second Division and three members from the Third Division, each to serve a three-year term. To be eligible for the office of Commissioner from a division, the nominee's mailing address must be in that Division as shown by the records of the Bar.

Applicants must be nominated by a written petition of ten or more members of the Bar in good standing and residing in their respective Division. Nominating petitions may be obtained from the Bar office on or after January 2 and completed petitions must be received no later than March 1. Ballots will be mailed on or about April 10, with balloting to be completed and ballots received by the Bar office by 5:00 p.m. on May 10. Ballots will be counted on May 11.

To reduce out-of-pocket costs and encourage candidates, the Bar will provide the following services at no cost:

1) Space for up to a 200-word campaign message plus a photograph in the March issue of the Utah Bar Journal. The space may be used for biographical information, platform or other election promotion. Campaign messages for the March Bar Journal publication are due along with completed petitions, two photographs, and a short biographical sketch no later than March 1.

2) A set of mailing labels for candidates who wish to send a personalized letter to the lawyers in their Division.

3) The Bar will insert a one-page letter from the candidates into the ballot mailer. Candidates are responsible for delivering to the Bar, no later than March 1, enough copies of letters for all attorneys in their Division. (Call the Bar for the count in your respective Division.)

2001 Annual Meeting Awards

The Board of Bar Commissioners is seeking nominations for the 2001 Annual Meeting Awards. These awards have a long history of honoring publicly those whose professionalism, public service and personal dedication have significantly enhanced the administration of justice, the delivery of legal services and the building up of the profession. Your award nomination must be submitted in writing to Maud Thurman, Executive Secretary, 645 South 200 East, Suite 310, Salt Lake City, Utah 84111, no later than Thursday,April 26, 2001. The award categories include:

3.Young Lawyer of the Year
4.Section/Committee

Want to brush up on your foreign language skills and at the same time help others access the legal services to which they are entitled? Ethnic and racial minorities here in Utah are being victimized by individuals purporting to be licensed attorneys. These so-called attorneys target Vietnamese, Hispanics, Russian, and other ethnic communities. They take money from their desperate “clients” and provide substandard (and sometimes harmful) legal advice or perform no service at all.

Utah Legal Services and the Minority Bar Association, in conjunction with the Utah State Bar Legal Assistant Division, the Multi-Cultural Center and the Bar’s Unauthorized Practice of Law (“UPL”) Committee need volunteers. Our mission is to educate cultural minorities through literature, the media and other resources. We need interpreters to assist with translation during the intake process and in the preparation of flyers and newspaper ads.

If you are interested in volunteering, please contact Susan Bailey, CLA, at (801) 322-2516, ext. 111. You may volunteer as little or as much time as your schedule allows.

Food and Clothing Drive Participants and Volunteers
We would like to thank all participants and volunteers for their assistance and support in this yearÕs Food and Clothing Drive. Although this is not a contest, we would like to give special recognition to the firm of Kruse Landa & Maycock as they have once again, as in every year of the eleven years we have conducted this food and clothing drive, donated more than any other firm.

We are happy to report than many firms were very well represented this year. Individual firms advised us that they took the suggestion made in our cover letter to use one person as a contact, as has been so successful with Kruse Landa & Maycock.
